Why was the Second Amendment written,
and why is it still important today?

Amendment II (1791)

"...A well regulated Militia, being necessary to the security of a free State,

the right of the people to keep and bear Arms, shall not be infringed."

What does it mean?

It means exactly what it says, that the people’s individual right to be armed will be respected and that the resulting armed populace will be secure against tyranny, invasion, and crime. Our founding fathers were careful to construct this sentence in such a manner that there could be no other reasonable interpretation besides the obvious. Anybody with even the most limited understanding of the English language will agree.

Why was it written?

We migrated to the United States to escape oppressive totalitarian government.
The concept behind the United States is that the centralized federal government has limited power over the people (as opposed to the dictatorships from which we came)

The Second Amendment states that in order to maintain a free state, the people must retain the right to keep and bear arms. The presence of armed citizens is what keeps the government "honest". No government would be foolish enough to impose a dictatorship on people who have the ability to resist.

The Second Amendment does not grant us this right. This right already existed.

The Second Amendment merely prevents the government from infringing on it.

Why is it still important?

There are those who would say, "The Second Amendment's not needed anymore. There's no threat of tyranny in our government." While it's fortunate that we've grown comfortable with our government, we need to remain aware that the only reason we have been able to grow comfortable with it is because the Second Amendment has prevented the government from posing a threat to us for all these years. History is littered with stories of unarmed citizens being taken over by dictators (Germany is one such example). Could that happen here? Not if we maintain the right to keep and bear arms. No other country has the freedoms that we have here in the United States. This is truly the most awesome place in the world to live, and it should stay that way. When politicians take an anti-Second Amendment stance, we seriously need to wonder about their motives.

Each and every amendment in the Bill of Rights is important, but the the Second Amendment is equal to all others because it guarantees that the others will not be taken away. Think about it. Once the right to own firearms is eliminated, eliminating all other rights (such as the Freedom of Speech) will be a piece of cake. If that happens, what are you going to do? Protest? You certainly can't resist. All you can do is watch it happen. The Second Amendment is our insurance policy against this. It's been working quite effectively for over 200 years, and as they say, "If it ain't broke, don't fix it!"

If you gun control advocates still dream of a day when the private ownership of guns is banned and the police are the only ones who are armed, feel free to relocate to the People's Republic of China, where your dream is a reality.

MILITIA??? Just what is the militia?

NOTE: "Well-regulated militia" does not mean the National Guard. At the time this was written, "well-regulated" meant "well-trained" (SHARPSHOOTER). If you believe "militia" means the National Guard, you must also believe that freedom of speech is reserved for the U.S. Government printing office.

If you read 10 USC Sec. 311 (That's Title 10 of the U.S. Code, Section 311, subtitle A part chapter 13) you'll find this:

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.

Well Philip if all fifty states did join in then we would have what is called a Constitutional Convention. The Convention would be made up of the fifty Governors if I remember correctly or a set of specially elected delegation elected by the people of each state or legislators of thoses states. Either way there would be a constitutiona convention.

We could then have our voices heard cause each of those states would have a petition to deal with. These petitions I am talking about must go to every level of government from local to federal and all branches of said governments.

They will have no choice but to listen at that time.

Again are there any lawyers in the house that can write up a legal petition!!!?

Let's getter done!

Philip, in light of your education from Judge Judy, I commend you and I think Our dear Leader is peeing on the constitution and telling us its raining.

I like your energy Leon.

I wish we could make the changes we want simply by adding our names to a list of petitioners in a court case.

That won't work. Courts don't decide cases based on how many people are lined up on one side of the issue or the other. Even if ALL 50 states joined together against Obama and Holder it wouldn't guarantee a victory for our side.

What we've been trying to do for the last 3 years since Obama and his gang of thieves took office is reverse the health care law that was written by the democrats while behind closed doors and we now call it Obamacare.

The TEA PARTY candidates that we voted into office in 2010 were supposed to help reverse the damaging legislation that the democrat congress had written into law the previous two years. THAT has not proven to be easy because some of our OWN Republican legislators won't do it.

The 2nd amendment right to bear arms is STILL under attack by the liberal progressive democrat machine. EVEN though the supreme court has recently ruled in gun owners favor. That doesn't stop them. They are still finding ways to hinder free ownership of guns and ammo.

I'm not an attorney, I'm not even a qualified court room observer. I learned most of my LAW from Judge Judy.

BUT I DO have a copy of The Constitution of the United States of America and a copy of The Unanimous Declaration of the thirteen United States of America (Declaration of independence) I do read and reference them often.

Stop f'king around with these people.

http://en.m.wikipedia.org/wiki/First_Amendment_to_the_United_States...
The First Amendment (Amendment I) to the United States Constitution is part of the Bill of Rights. The amendment prohibits the making of any law respecting an establishment of religion, impeding the free exercise of religion, abridging the freedom of speech, infringing on the freedom of the press, interferingwiththe rightto peaceably assemble or prohibiting the petitioning for a governmentalredressof grievances.

Originally, the First Amendment applied onlyto laws enacted by the Congress. However, starting with Gitlow v. New York, 268 U.S. 652 (1925), the SupremeCourt has held that the Due Process Clause of the Fourteenth Amendment applies the First Amendment to each state, including any local government.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. ”

Ok, so let's petition the government for a redress of grievances.

How do you do that?

Through the courts!

Start at the lowest possible level and work our way up adding as many petitions as possible as we go with the maximum amount of signitures (petitioners) as possible. This means business, corporations, cities, states, and individules and those businesses, corporation, that don't sign we boycott them, and those cities, counties, states, judges, congressmen, senators, and any other servant that refuses to sign we throw their asses out of office and if it is an unelected servant then we petition to get them thrown out of government and put a clause in the petition that they can never hold another position in government (elected or otherwise).

Let's quit pussy-footing around with those morons and take real steps to let them know who the boss is.

I would enjoy reading those results Philip, please post. It is a wonderful thing when we can add and subtract our differing opinions to come up with a more balanced (perfect) union (train of thought).

Look, the constitution is a contract by the people to the government. If the government violates that contract then we the people must petition the government through the courts of said violations, just like any other contract and the more the petitioners the stronger that petition is. So if we get enough signitures on a petition to the courts the more likely that the court will rule against congress and the president the other two branches of government.

Look you folks (me included) do not have to wait for the state or anyone else to petition the government for anything. If we don't like the healthcare laws we need to be added to the petition standing before SCOTUS right now. It is very simple, contact the lawyers and have your name added to the petitioners. Just cause 26 states are petitioning doesn't mean sqwat, let's add our individual names to that to. Force them to comply instead of them forcing you to comply.

You sure do have a "different" way of summing things up Leon.

But when I add up the same numbers I get a different result.

Comment by Leon Ewers on November 30, 2011 at 4:55am
Lol I was being sarcastic. Actually if I get all this right, the Constitution doesn't really apply to us (humans) it applies to the government. So keep your guns, prey to what ever it is you prey to (yes that means in schools to and or any government building, put your crosses up and your ten commandments where ever it is you like cause all that crap in the Constitution applies to the government. The Second Amendment is telling the government what they can't do and that is they can "not" infringe on our god given right to bear arms. It doesn't say that you can only own this type or that type of weapon, it says that they can not infringe on your right to bear arms period. So arm yourself to the teeth with what ever you can get your hands on, this includes but not limited to teasers, flack jackets, helmets, face shields, pepper sprays or any other type chemical weapon even if you have to buy it on the black market, knifes of all sorts, guns of all sorts, swords, other oriental type weapons - throwing stars, chains with blades on the end, staffs, batons, brass knuckles, tanks, cannons even if you have to make your own . . . Any weapon... er arms. It is your god given natural right to defend yourself against all enemies foriegn or domestic to include the made up, make believe, fictitious government. What I mean by "fictitious" is that it is something that man created, not god. It is a false idol and all those that serve it are nothing more than "TEMPLE SODOMITES (PROSTITUTES)".
