Filibuster Reid Gun Control Bill Now

 

When you are in the minority in the Senate, there is one thing you can do to stop unconstitutional legislation from getting started. You filibuster the motion to proceed with debate. We are all painfully aware that once the amendment process gets rolling, too many GOP senators are enticed into cutting a deal. Momentum builds for passage of the underlying bill, and Republicans feel the pressure to merely ameliorate the bill instead of killing it. That is what happened with Obamacare. That is what is about to take place with the gun control bill.

As early as this Tuesday, Senate Majority Leader Harry Reid plans to bring the most sweeping gun control bill to the Senate floor since the ‘90s. The Senate Judiciary Committee has passed a slew of gun control measures in short order without bothering to submit a committee report. Reid, with the help of Chuck Schumer and Pat Leahy, has combined many aspects of those bills into one single bill – S.649, which is given the Orwellian name "Safe Communities, Safe Schools Act of 2013." Reid will attempt to invoke cloture on the motion to proceed early this week.

Republicans must pledge to block it from the floor and use every dilatory tactic to ensure that the train never gets rolling.

Senators Cruz, Rubio, Rand Paul, Lee, Inhofe, Crapo, Moran, Burr, Johnson of Wisconsin, Enzi, Risch , Crapo, Coats, and Roberts have already pledged to filibuster the motion to proceed. We need 29 more commitments, including a willingness on the part of the Mitch McConnell to lead from the front on this issue.

Here are some basic problems with the bill

National Gun Registry:

At present, federal law only requires those who buy guns from a licensed dealer to submit to a background check under the National Instant Criminal Background Check System (NICS). The NICS law was designed to protect against any attempt to record information and create a registry on guns and gun owners. It merely requires sellers to check whether that individual is listed as someone ineligible to own a firearm. Title 1 (Section 122) of the Reid bill extends the requirement for a background check to any private gun sale. In doing so, the law directs Eric Holder to require a "record of transaction of any transfer that occurred between an unlicensed transfer or and an unlicensed transferee." There is no protection in the bill against Justice Department officials using the information to create a database on gun owners.

Private Sales:

As noted, the centerpiece of the bill is a provision that would abrogate the right of an individual to sell or rent a firearm to a friend or family member without involving the federal government. We all must understand that those who perpetrate the violent crimes on the streets of cities like Chicago will never submit to such a process. This will only affect peaceful gun owners. It will grant an already overzealous ATF the authority to track down gun owners they deem suspicious and entrap them in the legal tape of private gun transfers. We should never have the federal government involved in private gun sales.

Gun Tax:

Section 122 of the bill authorizes the Attorney General (the same man who was involved in the worst gun smuggling scandal ever) to levy a tax on those private sales in order to pay for the expanded background checks. Incidentally, the fact that this bill levies a new tax on gun purchases should disqualify the entire legislation under the "blue slip" rule. Pursuant to the Origination Clause of the Constitution, any revenue-raising provision that originates in the Senate instead of the House is invalid.

Criminalizing Gun Owners:

Section 123 of the bill requires all gun owners to report lost firearms to the Attorney General within 24 hours. Failure to report a loss or theft would be deemed a felony punishable with up to 5 years in prison.

Helping Criminals Pass Background Checks:

While this bill does nothing to prevent violent crimes, it might actually make it easier for criminals to find which states have the most deficient background checks.

David Addington of the Heritage Foundation notes

that Section 112 (b) of the bill requires the Attorney General to publish a website ranking the states in order of how much data they have submitted to the background check system. For all the talk about loose gun laws helping criminals, this law will provide them with a handy list of states with bad background check systems.

Veterans Gun Ban:

There’s a provision in the bill which could punish anyone who sells a gun to a veteran without realizing he has PTSD.

The aforementioned concerns notwithstanding, we must remember that any Democrat gun bill is designed to open the door on limiting the Second Amendment, not clamp down on violent crime. They are employing a simple strategy of trimming around the edges on aspects of gun control that poll well, in the hopes that Republicans would have a hard time opposing "such commonsense" measures. It’s similar to their tax increase subterfuge in which they propose a tax increase "just on the very wealthy" in order to get Republicans to break their intrepid stance on the issue.

Unfortunately, this ploy is working. John McCain is ridiculing the conservatives for filibustering the bill. Tom Coburn is questioning Rand Paul’s sincerity on filibustering the bill, even as he is trying to concoct his own enhanced background check legislation. And Pat Toomey is trying to bail out Joe Manchin by cutting a compromise deal, which would exempt immediate family members from the background checks while leaving the rest of private sales subject to the backdoor gun registry.

Folks, we’re in a world of hurt. In a profound twist of irony, the Senate will be considering a new gun bill which seeks to regulate "undocumented guns" at the same time the Gang of 8 releases its amnesty plan for illegal aliens. We are living in absurdastan. Through the worst eras of big government Republicanism, the party has always stood strong on taxes and guns. Now, after the McConnell tax hikes and the impending gun control cave, there is nothing left of the GOP.

 

Please call your Republican senators and let them know that when the Second Amendment reads "shall not be infringed" it means just that. Call Mitch McConnell’s office and ask if he plans to lead the filibuster against this terrible piece of legislation.

RE: Failure to Filibuster Obama's Legislative Assault on the Second Amendment (S. 649) Will Be Viewed by the American People as a Violation of Your Oaths of Office!

With a vote scheduled for this week on a motion to proceed on Barack Obama's gun control legislation, remember that upon taking office, each and every U.S. Senator took an oath, solemnly swearing (or affirming) to "support and defend the Constitution of the United States." And each and every U.S. Senator further swore to do so "without any mental reservation or purpose of evasion."

Yet, far too many Senators either refuse to take their oaths seriously or are simply confused when it comes to what the Constitution actually says. Specifically, the Second Amendment to the Constitution reads: "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

According to the Oxford Dictionary, the word "infringe" means: "Act so as to limit or undermine (something); encroach on." For those of us who put our pants on one leg at a time, that's pretty clear cut. The Constitution is not to be limited... or undermined... or encroached upon.

It is not the job of a United States Senator to "debate" legislative measures which infringe upon the Constitution. It is not the job of a United States Senator to craft "fixes" or "compromises" or "grand bargains" on measures which infringe upon the Constitution.

Put plainly, you have an oath to support and defend the Constitution and any Senator that does not join the effort to filibuster the legislative assault on the Second Amendment (S. 649) is IN VIOLATION OF THAT OATH... PERIOD!

Safe Communities, Safe Schools Act of 2013 - Amends the NICS Improvement Amendments Act of 2007 (NICS Act), the Brady Handgun Violence Prevention Act (Brady Act), the Omnibus Crime Control and Safe Streets Act of 1968, and the federal criminal code to require background checks for all firearm sales, prohibit straw purchases of firearms, and expand the school safety grant program.

Fix Gun Checks Act of 2013 - Amends the NICS Act to eliminate from the records concerning persons who are prohibited from possessing or receiving a firearm, about which a state must submit estimates to the Attorney General for purposes of the National Instant Criminal Background Check System: (1) a record that identifies a person for whom an indictment has been returned for a crime punishable by imprisonment for a term exceeding one year or who is a fugitive from justice and for which a record of final disposition is not available; and (2) a record that identifies a person who is an unlawful user of, or addicted to, a controlled substance. Directs the Attorney General to establish the applicable time period for the occurrence of events which would disqualify a person from possessing a firearm (currently, within the prior 20 years) in pertinent records.

Replaces provisions requiring that a specified percentage of grants to states and Indian tribal governments for establishing, planning, or improving identification technologies for firearms eligibility determinations be used to maintain a relief from disabilities program with provisions authorizing states to use such grants for such a program. Authorizes appropriations for FY2014-FY2018 for such grants and eliminates allocation restrictions based on the percentage of records states provide.

Revises the periods during which the Attorney General may withhold Edward Byrne Memorial Justice Assistance Grant funds from states that do not provide specified percentages of required records. Eliminates the Attorney General's authority to waive such withholding if a state provides evidence it is making a reasonable effort to comply.

Requires the Attorney General to publish and made available on a publicly accessible website an annual report that ranks states by the ratio of the number of records submitted by each state under the NICS Act to the estimated total number of available records of the state.

Amends the Brady Act to include federal courts as federal agencies from which the Attorney General is authorized to secure information on persons prohibited from receiving a firearm.

Amends the Brady Act to prohibit any person who does not hold a federal firearms license from transferring a firearm to any other unlicensed person unless a licensed importer, manufacturer, or dealer: (1) has first taken possession of the firearm for the purpose of complying with national instant criminal background check requirements; and (2) upon taking possession, complies with all firearms requirements as if transferring the firearm from the licensee's inventory to the unlicensed transferee. Specifies exceptions, including for: (1) bona fide gifts between immediate family members; (2) a transfer from a decedent's estate; (3) a transfer of possession between unlicensed persons in the transferor's home for less than seven days; and (4) certain temporary transfers without the transfer of title in connection with lawful hunting or sporting purposes at a shooting range, at a shooting competition, or while hunting, fishing, or trapping during hunting season.

Authorizes the Attorney General to implement this section with regulations that shall include provisions: (1) setting a maximum fee that may be charged by licensees for services provided, and (2) requiring a transaction record of any transfer that occurs between an unlicensed transferor and unlicensed transferee.

Makes it unlawful for any person who lawfully possesses or owns a firearm that has been shipped, transported, or possessed in interstate or foreign commerce to fail to report the theft or loss of the firearm to the Attorney General and the appropriate local authorities within 24 hours of discovery.

Stop Illegal Trafficking in Firearms Act of 2013 - Amends the federal criminal code to prohibit any person, other than a licensed firearms importer, manufacturer, collector, or dealer (licensed dealer), from knowingly purchasing in interstate or foreign commerce (including through receipt on consignment or by way of pledge or pawn as security for payment) a firearm from a licensed dealer, or from any person who is not a licensed dealer, for another individual, knowing or having reasonable cause to believe that such individual meets specified criteria disqualifying such individual from possessing a firearm. Sets forth an enhanced penalty for such a violation committed knowing or with reasonable cause to believe that any firearm involved will be used to commit a crime of violence. Specifies exceptions for purchases for certain bona fide gifts or for a bona fide winner of an organized raffle, contest, or auction.

Prohibits: (1) transferring two or more firearms to, or receiving two or more firearms from, a person in interstate or foreign commerce knowing or with the reasonable belief that such transfer, possession, or receipt would violate a federal law punishable by a term of imprisonment exceeding one year; or (2) attempting or conspiring to commit such conduct. Authorizes an enhanced penalty for someone who organizes or supervises such conduct.

Subjects: (1) property derived from or used to commit such an offense to forfeiture, and (2) a person who derives profits from such an offense to a fine equal to twice such profits.

Includes firearm trafficking offenses: (1) among offenses for which wiretapping may be authorized, (2) within the definition of "racketeering activity," and (3) within the definition of "specified unlawful activity" for purposes of money laundering violations.

Directs the U.S. Sentencing Commission to review and amend its guidelines and policy statements to: (1) ensure that persons convicted of offenses involving straw purchases of firearms and firearms trafficking are subject to increased penalties; and (2) reflect congressional intent that a person convicted of such offense who is affiliated with a gang, cartel, or organized crime ring should be subject to higher penalties.

Amends the Brady Handgun Violence Prevention Act to prohibit the sale or other disposition of a firearm or ammunition knowing or having reasonable cause to believe that the purchaser intends: (1) to sell or otherwise dispose of it to a person in a category of individuals excluded from firearms possession, (2) to sell or otherwise dispose of it in furtherance of a crime of violence or drug trafficking offense, or (3) to export it in violation of law.

Increases the maximum terms of imprisonment for violating prohibitions against: (1) selling firearms or ammunition to any person knowing or having reasonable cause to believe that such person is disqualified from possessing such firearms or ammunition; (2) any such disqualified person transporting or possessing any firearm or ammunition in interstate or foreign commerce or receiving any firearm or ammunition that has been has been transported in interstate or foreign commerce; (3) receiving or transferring a firearm or ammunition knowing or having reasonable cause to believe that it will be used to commit a crime of violence, a drug trafficking crime, or other specified crimes under the Arms Export Control Act, the International Emergency Economic Powers Act, the Foreign Narcotics Kingpin Designation Act, or the Immigration and Nationality Act; or (4) smuggling into or out of the United States a firearm or ammunition with intent to engage in or promote conduct that is punishable under the Controlled Substances Act, the Controlled Substances Import and Export Act, or maritime drug law enforcement provisions or that constitutes a crime of violence.

Prohibits the Department of Justice (DOJ) and any of its law enforcement coordinate agencies from conducting any operation where a federal firearms licensee is directed or encouraged to sell firearms to an individual if DOJ or a coordinate agency knows or has reasonable cause to believe that such individual is purchasing such firearms on behalf of another for an illegal purpose, unless the Attorney General, the Deputy Attorney General, or the Assistant Attorney General for the Criminal Division approves the operation in writing and determines that the agency has prepared an operational plan to prevent firearms from being transferred to third parties without law enforcement taking reasonable steps to lawfully interdict those firearms.

School and Campus Safety Enhancements Act of 2013 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to authorize school security grants by the DOJ Office of Community Oriented Policing Services to be used for the installation of surveillance equipment and the establishment of hotlines or tiplines for the reporting of potentially dangerous students and situations.

Requires a grant application to be accompanied by a report that is signed by the heads of each law enforcement agency and school district with jurisdiction over the schools where the safety improvements will be implemented and that demonstrates that each proposed use of the grant funds will be: (1) an effective means for improving school safety, (2) consistent with a comprehensive approach to preventing school violence, and (3) individualized to the needs of each school.

Requires the Director of the Office of Community Oriented Policing Services and the Secretary of Education to establish an interagency task force to develop and promulgate a set of advisory school safety guidelines.

Authorizes appropriations for such grant program for FY2014-FY2023.

Center to Advance, Monitor, and Preserve University Security Safety Act of 2013 or CAMPUS Safety Act of 2013 - Amends the Omnibus Crime Control and Safe Streets Act of 1968 to authorize the Attorney General to: (1) establish and operate a National Center for Campus Public Safety; and (2) make subawards to institutions of higher education and other nonprofit organizations to assist the Center in carrying out its assigned functions, including providing education and training for public safety personnel of institutions of higher education, identifying and disseminating information, policies, and best practices relevant to campus public safety, and promoting cooperation among public safety and emergency management personnel of institutions of higher education and their collaborative partners.

Biden mocks gun skeptics: ‘We’re going to swoop down with Special Forces folks and gather up every gun in America’

During a gun control speech Tuesday at the White House, Vice President Biden mocked the “black helicopter crowd” for opposing the idea of universal background checks for Americans purchasing guns.

“Kinda scary man, the black helicopter crowd is really upset,” Biden said, criticizing the National Rifle Association for promoting a “misinformation campaign” on background checks.

Biden insisted that there would be no central registry for background checks allowing government to keep records on gun owners.

“No way that Uncle Sam can go find out whether you own a gun because we’re about to really take away all your rights and you’re not going to be able to defend yourself and we’re going to swoop down with Special Forces folks and gather up every gun in America,” Biden added mockingly. “It’s bizarre. But that’s what’s being sold out there.”

This administration is making preparations for SOMETHING and that SOMETHING smells suspiciously like a fake or "created crisis" just like a failure of the US DOLLAR which has already begun.

'Stability Police Forced'

Darrell Castle is a retired Marine Corps officer with service in Vietnam, a practicing attorney and the Constitution Party’s 2008 vice presidential nominee. Castle is skeptical of the report and believes the unit could be used in the U.S. Against Americans.

“First, you have to approach anything done by or for the federal government in light of what I believe the ultimate goal of the federal government to be,” Castle said.

“As I see it, the goal is to do the bidding of the international cartel of central bankers and financiers in order to assist them in building a world government police state which would entail total surveillance, total control, and the absence of what we think of as constitutional rights,” he said.

Castle added that even though the report focuses mostly on foreign deployments, some of the language leaves open the possibility for domestic use.

“To that end, the question becomes, how does a stability police force for the United States move the federal government closer to its goal of totalitarian control? When the question is asked in that manner, the answer becomes fairly obvious,” Castle warned.

Castle believes the goal is power, and a major springboard for such a power grab comes from the economy.

“Conditions have been intentionally created within the United States which make some kind of chaotic catastrophe very likely. This event could be anything the mind of man can dream up due to the overwhelming public debt and huge deficit which is budgeted to grow by trillions over the next few years,” Castle said.

“Hyperinflation and the resulting loss of the dollar’s reserve status seems unavoidable. The United States is now at deficit spending which is 40 percent of the budget and climbing,” Castle said.

To illustrate his point, Castle turned to history.

“The Weimar government in pre-Hitler Germany accelerated deficit spending to 70 percent of budget and when it did, hyperinflation occurred with its ruination of the German nation that started a cataclysmic chain of events in motion,” he said.

“The Stability Police Force then is necessary to control the population much as the U.S. Military is attempting to control the remaining population of Haiti right now. It is part of a long existing effort to mingle and combine all law enforcement, federal, state, and local with the military into one force,” Castle said.

Castle is not the only one who thinks the Stabilization Police Force is the next step in establishing a totalitarian state.
