Obama Seeks Extradition of ICE Agent’s Murderer

During a press conference with Mexican President Felipe Calderon Thursday, President Obama announced that the U.S. government filed a formal extradition request to Mexican authorities for the killer of Immigration and Customs Enforcement (ICE) Agent Jaime Zapata.   (LA Times, Mar. 3, 2011) “We expect the full weight of the law to be brought against this perpetrator,” Obama said.  He declined to comment further. 

Agent Zapata was shot to death and fellow agent, Victor Avila, suffered two gunshot wounds to his leg when their Chevy Suburban was attacked as they were returning to Mexico City from a meeting with other U.S. personnel in the Mexican state of San Luis Potosi.  (Fox News Latino, Feb. 24, 2011; See also FAIR Legislative Update, Feb. 22, 2011) Mexican authorities claimed to have arrested ICE agent Zapata’s murderer at the end of last month. (Fox News Latino, Feb. 24, 2011) Suspect Julian Zapata Espinoza, a cell leader in the Zeta drug cartel, claimed he mistook agent Zapata’s vehicle for one used by a rival gang. (Id.) Nonetheless, some U.S. officials maintain the attack was an intentional ambush of the agents and said the gunmen made comments before they fired indicating they knew who their targets were. (Id.)

Julian Zapata Espinoza was one of six arrested by the Mexican Army in connection with Agent Zapata’s murder.  (Id.) The army quoted the suspect as saying only two of the other men arrested had participated in the attack on the ICE agents, but did not specify which of the five. (Id.) One of the men reportedly had a swollen, bruised face, and soldiers found five rifles at the four houses raided, according to Mexican authorities. (Id.)

It is unclear at this point whether President Calderon will cooperate with President Obama’s request.  Calderon stated that he would “have to reserve [his] opinion” on the matter and see what the law permits.  “There is the political will . . . that this individual be brought to justice with the full weight of the law, whether that be in the United States or in Mexico,” Calderon remarked.

Murdered Border Agent Brian Terry Armed With Beanbag Rounds?

Unconfirmed, but unsurprising: Border Agent Brian Terry, killed presumably by Mexicans at the border, is said to have been armed only with beanbag rounds or rubber bullets.

Meanwhile, the Mexicans are armed to the teeth.

DHS has released virtually no information about the incident, likely confirming yet another example of gross malfeasance by Big Sis and her crew.

The Tucson Citizen hopes for the best:

If the report turns out to be true that Agent Terry was armed with non-lethal weapons and was working in an area known for its high degree of violence… that ought to send President Obama a message that there needs to be some drastic changes in the management of the Border Patrol.

But Comrade Obama has been getting that message for two years; he disregards it. The Border Patrol is doing its intended job, which is letting in hordes of future Democrat-voting welfare recipients. Unfortunately for the guys on the ground, the farce of pretending to defend the border while not defending it at all requires a few pawns to be sacrificed.

It would be nice to think that Terry died while defending his country. Actually, he died while providing free police services to hostile aliens as they invaded. He was protecting illegal aliens from Mexican bandits who prey on them, as part of a promise Big Sis made while visiting her friends south of the border.

The border could be sealed in a day. But that won't happen so long as America is run by its enemies. Terry died as a result.

Murdered Border Patrol Agent Brian Terry Was Armed with … Beanbags?

A political policy that left a Border Patrol agent facing lethally armed men with only a beanbag gun is likely responsible for his death.

Beanbags are wonderful inventions. They make comfortable if kitschy furniture, are a simple toy useful for early childhood development, and of course, are a key component of the addictive but disturbingly named game of cornhole.

One thing beanbags are decidedly not appropriate for is being the primary armament of elite military and police agencies, a self-evident fact to almost everyone.

Late on the night of December 14, an elite tactical unit of the U.S. Border Patrol known as “BORTAC” was working the Peck Canyon, northwest of Nogales. They were hunting a “rip crew” suspected to be operating in the area. A rip crew is a predatory criminal gang that targets drug couriers and illegals being smuggled over the border. They ambush their victims, robbing and assaulting them for their drugs or few possessions, supposing their criminal victims will never report their crimes to authorities.

Using night vision equipment, the BORTAC team spotted five men moving through the Canyon, two of whom were carrying rifles. At least one of the officers identified the men and yelled at them to drop their weapons. Then things went bad:

When the suspected aliens did not drop their weapons, two Border Patrol agents deployed “less than lethal” beanbags at the suspected aliens. At this time, at least one of the suspected aliens fired at the Border Patrol agents. Two Border Patrol agents returned fire, one with his long gun and one with his pistol.

Border Patrol agent Brian Terry was shot with one bullet and died shortly after. One of the suspected illegal aliens, later identified as Manuel Osorio-Arellanes, was also shot.

Yes, you read that correctly. Faced with men using rifles, Border Patrol agents used beanbags. Why? Because of an alleged agency policy that requires engaging armed men with beanbag rounds.

Agency doctrine that all but assured the eventual death of a federal agent. BORTAC agent Brian Terry just happened to be that first unfortunate victim of a policy developed as a combination of bureaucratic ineptitude and feel-good policing mandated by those far from the front line of America’s Third War.

The technology of beanbag rounds are not to blame. Beanbag rounds have been around for a number of years as one of the first iterations of “less lethal” weapons designed to force a criminal suspect’s compliance through the assertion of concussive force. They are fired from designated shotguns that are usually brightly colored so they won’t be confused with shotguns loaded with buckshot or slugs. A shot-filled sock-like projectile is fired at a low velocity of several hundred feet-per-second to deliver a stunning, momentarily incapacitating blow to allow officers to rush in and physically control an uncooperative suspect.

Doctrine has long been that less-lethals are only to be used in very prescribed situations where the subject is deemed to be a threat to themselves or others, but is not an immediately direct lethal threat. A good example would be a combative person thought to be under the influence of drugs that does not allow officers to approach within taser range. The beanbag shells themselves have very narrow operating windows or ranges: lower velocity shells are to be used  from 5-20 yards, while higher velocity variants of varying designs are tailored to ranges out to 40 yards.

There is one very important caveat to using less-lethal weapons. The standard doctrine for these less-lethal weapons is that they are only to be used in situations where the suspects are not armed with deadly weapons of their own.

The reason is obvious. Filled with less-lethal shells, a shotgun is still unmistakably a shotgun, and when the trigger is pulled, a shotgun blast is heard, a flash and puff of smoke is seen and heard, and the weapon recoils. Any person carrying a weapon and not immediately incapacitated by the less-lethal cartridge itself is likely to judge that their life is in danger and immediately return fire with their own far more lethal firearms.

This confusion was compounded by the fact that the event happened close to midnight; there was absolutely no way for the rip crew to verify they were actually facing off against law enforcement officers and not another rip crew. All they knew is that they were yelled at by men who identified themselves as police, and then those men started shooting at them.

It’s a matter of training. It’s a matter of common sense.

And it’s a matter of near criminal proportions that both long-held and carefully researched doctrine about the use of force was thrown out the window in favor of what was clearly a bureaucratic initiative made by someone hoping to mitigate the political fallout that might occur if Border Patrol agents shot a criminal alien and either killed or seriously wounded him or her.

Border Patrol officials lied at least once about the order to use beanbags in what appears to be an obvious attempt to cover up a lethally poor policy.

Was the policy a result of uniformed agents shooting and killing a rock-throwing Mexican teen in June of 2010? Was it the result of the generally apathetic to hostile feelings towards border security from DHS appointees and the White House itself?

The only appropriate responses are an immediate revocation of the policy before it leads to the death of other Border Patrol agents and an investigation into how the policy came into being and into who was responsible for trying to cover it up and why.

Rumor confirmed: Murdered agent Terry armed with beanbag rounds

This corroborates a rumor that has been widely circulating since the mid-December shootout, when Border Patrol Agent Brian Terry was fatally wounded in Peck’s Canyon after encountering armed illegal immigrants who would not obey commands to drop their weapons.

A key point is highlighted in this new report:

The Terry family remains upset about allegations that the Bureau of Alcohol, Tobacco, Firearms and Explosives allowed a gun smuggler it was investigating to purchase and smuggle into Mexico the weapons used in the shootout in which Terry died. The Justice Department has denied the allegations, but U.S. Sen. Charles Grassley, R-Iowa, continues to insist on the validity of the claims.

Another key point remains unresolved. The autopsy has shown “Terry was shot once in the lower back, about 29 inches down from the right shoulder…The bullet found inside his body was one used with AK-47s...”

So of course this means the government also knows which gun was used to kill Agent Terry. That the Justice Department refuses, as yet, to confirm that points to the same intentional stonewalling that kept the beanbag information suppressed for so long.

Officials who do not want information about the circumstances of Agent Terry’s death and about wider “Project Gunwalker”* allegations to come to light are engaging in a cover up.  That makes redoubled efforts by Senator Grassley of utmost importance.  Reports indicate the Department of Justice missed the Feb. 23 deadline he gave them to begin producing documents, and this correspondent left a voice mail with Grassley’s press secretary seeking confirmation of that.

This also highlights the critical need for Rep. Darrell Issa to initiate parallel oversight hearings in the House.  It is clear ATF management and their DOJ handlers have no intention of producing information unless it is dragged out of them.

Let the dragging begin.
