Sen. Ted Cruz’s filibuster had become the fourth-longest in Senate history and was still going Wednesday morning, as the Texas Republican continued to hold the chamber floor to highlight the GOP’s effort to defund Obamacare.
He took control of the floor at 2:41 Tuesday afternoon and crossed the 18-hour, 23-minute mark at 9:04 Wednesday morning, officially passing Sen. Robert La Follette Sr.’s filibuster in 1908.
“As difficult as it is to cross one’s party leaders, I say — with perhaps a little familiarity to the consequences — that it’s survivable, and ultimately it’s liberating,” Mr. Cruz said in the early morning hours of his talk-a-thon.
Over night he read excerpts from both Ayn Rand’s “Atlas Shrugged” and from Dr. Seuss’ “Green Eggs and Ham” on the floor, cited approvingly the words of wisdom from actor Ashton Kutcher and hit TV show “Duck Dynasty,” carefully sipped water, and grabbed a quick snack at one point while fellow filibuster leader Sen. Mike Lee asked a 45-minute-long question, giving the Texas Republican a chance to stretch his legs, check messages on his iPhone and confer with his staff.
His filibuster has easily topped that of Sen. Rand Paul, who earlier this year held the floor for nearly 13 hours as he protested President Obama’s drone policy.
As 9 a.m. neared, Mr. Cruz was comparing his fight against the D.C. establishment to the rebel alliance in the “Star Wars” movie series, and even did an impression of Darth Vader, appropriating the villain’s famous line for one of his own colleagues as he intoned: “Mike Lee, I am your father.”
Mr. Lee, a Utah Republican, stayed throughout the night at Mr. Cruz’s side on the Senate floor.
Movies were a theme for Mr. Cruz, who as dawn broke was pondering the better horror movie comparison for the health care law — “Friday the 13th” movie series protagonist Jason, or the “Nightmare on Elm Street” movie franchise anti-hero Freddy.
“You can make a powerful argument for Jason because Obamacare is the biggest job-killer in this nation,” Mr. Cruz said. “But on the other hand, you could make a powerful argument for Freddy because, as James Hoffa said, president of the Teamsters, Obamacare is a nightmare.”
Mr. Cruz had vowed Tuesday afternoon to keep talking until he couldn’t stand any longer, and he repeated that pledge Wednesday, 18 hours in.
Mr. Cruz will not be able to reach the third-longest filibuster in history, a 22-hour and 26-minute affair in 1953, because under the rules, the Senate will have to adjourn its session at noon and then immediately reconvene with Majority Leader Harry Reid granted the right to control the floor.
Democrats disputed calling Mr. Cruz’s effort a filibuster, arguing that because a vote is locked in for later Wednesday, there is a final limit on how long Mr. Cruz could speak, and therefore he wasn’t able to really block any action.
By speaking, Mr. Cruz was stalling the time and making colleagues have to wait by speaking all Tuesday afternoon.
In his remarks, he repeatedly took aim at fellow Republicans, urging them to join him in voting against limiting debate on a stopgap spending bill that also defunds Obamacare. Many Republicans said they will vote along with Democrats to proceed with the stopgap bill because as of now it contains the defunding provisions.
Mr. Cruz, though, said it is certain Democrats will be able to strip the defunding provision with a majority vote later in the process, so the only chance to exert influence is early on, when it will take a 60-vote threshold to even proceed with action.
Mr. Paul’s filibuster earlier this year, which delayed a confirmation vote on the CIA director’s nomination, lasted just over 12 hours and 50 minutes — a mark Mr. Cruz crossed just after 3:30 in the morning.
But where Mr. Paul began before noon and lasted into the night, Mr. Cruz went on from afternoon through night and into the morning, aided in the wee hours only by Mr. Lee, who regularly popped up on the floor to ask questions.
At 5:30 a.m., there were still four members of the public in the viewing gallery — all of them men, each apparently here alone — watching Mr. Cruz’s effort.
The Texas Republican had built himself a sort of nest at his desk, in the back corner of the GOP’s side of the chamber, with a wristwatch to one side, his iPhone on another side and sheafs of papers all around.
