Gun bill clears key Senate hurdle with (bipartisan) support. That means some Republicans voted FOR it . . . . Republican senator Pat Toomey helped WRITE IT!

A new gun control law cleared a major Senate hurdle Thursday, with 16 Republicans voting with most of the chamber’s Democrats to begin the process of moving one of President Barack Obama’s top domestic initiatives through a long, legislative slog.

Senators voted 68 to 31, with a handful of Republicans joining most Democrats, on a procedural measure to begin consideration of a proposed gun law that would expand background checks for gun sales, and strengthen mental health and school safety programs.

The vote is just the opening step, though, of a debate that could stretch out for weeks and encounter any number of obstacles – namely, the Republican-controlled House of Representatives – before reaching Obama’s desk.

Thursday’s vote comes on the heels of a bipartisan Senate agreement on Wednesday on expanding background checks, the centerpiece of gun control advocates’ effort to strengthen rules on firearms following the December 2012 shooting at an elementary school in Newtown, Conn.

Two senators – Democrat Joe Manchin from West Virginia and Republican Pat Toomey of Pennsylvania – struck an agreement that would extend existing background check rules to gun sales made online, and at gun shows. (Manchin and Toomey said their plan would be offered as the first amendment to the underlying gun bill which senators called up today.)

While their accord prompted renewed hope of bipartisan action to advance new gun laws for the first time in years, their proposal (along with several other gun measures slated for consideration by Congress) still face stiff resistance from conservative Republicans and the influential gun rights lobby, the National Rifle Association.

The NRA released a letter late Wednesday saying it was “unequivocally opposed” to the new gun rules, including the Manchin-Toomey proposal. Their declaration may weigh heavily on lawmakers seeking the NRA’s support – or, at the very least, avoid being targeted by the group – in their re-election efforts next fall.

“Given the importance of these issues, votes on all anti-gun amendments or proposals will be considered in NRA’s future candidate evaluations,” wrote their chief lobbyist, Christopher W. Cox, in a letter to members of Congress.

And a group of Republican senators have vowed to slow down the legislation by offering a multitude of amendments to the gun legislation, and exhausting the hours of debate to which they are entitled for each amendment. Those conservative lawmakers are backed by Senate Minority Leader Mitch McConnell, R-Ky., who voted Thursday against even beginning formal debate on gun legislation.

"The senators who have vowed to filibuster this bill should be ashamed of their attempt to silence efforts to prevent the next American tragedy," said 33 family members of Newtown victims in a joint statement. "Their staunch opposition to sensible gun reform is an affront to the 26 innocent children and educators who were murdered in Newtown."

The Senate bill could also be undone by so-called “poison pill” amendments which Republicans could attach with the help of a few swing-state Democrats, but risk making the whole bill unacceptable to most other Democratic senators.

Sen. Charles Schumer, D-N.Y., highlighted a provision that would require states to recognize concealed carry permits from other states as an example of one such poison pill.

Nonetheless, the coming Senate debate will provide an exercise in posturing – both on the central proposal dealing with background checks, but also additional measures that are all but certain to fail, like a proposed renewal of the ban on assault weapons, and a ban on high-capacity magazine clips.

The debate will play out as new poll data showed that a majority of Americans generally favor stricter gun laws. A new NBC News/Wall Street Journal poll released Thursday found that 55 percent of Americans favor gun laws, versus 34 percent who prefer to keep the laws as they are now. Nine percent of Americans prefer less strict gun laws.

Gun Compromise Will Allow Doctors to Block Your Right to Guns

I just talked to someone familiar with the Toomey-Manchin proposal who raises a serious concern based on his understanding of the legislation.

Everyone on all sides agrees that we need better help for those with mental health problems who need treatment.

Unfortunately, the person I talked with is concerned that the Toomey-Manchin proposal could discourage people from getting help.

The proposal will allow a doctor to add a patient to the National Instant Criminal Background Check System (NICS) without ever telling the patient he or she has been added.

There would be no due process requirement. Not all doctors will be able to do it with the same ease, but many will. Knowing a doctor could add him to a federal database as mentally ill without his knowledge could potentially dissuade a patient from going to the doctor in the first place to get help.

Vice President Joe Biden said too many people own guns simply because they “like the way it feels,” and compared the handling of an AR-15 assault weapon for some to driving a pricey sports car.

“There is a whole new sort of group of individuals now that never hunt at all,” Biden said in an interview taped Wednesday and aired Thursday on MSNBC’s “Morning Joe.”

“But they own guns for one of two reasons — self-protection, or they just like the feel of that AR-15 at the range. ... They like the way it feels. It's like driving a Ferrari, you know.

“And so my impression is there’s not the same sort of cultural norm about gun ownership with a lot of people who are buying guns now.”

The vice president continued his criticism of the National Rifle Association, saying the powerful pro-gun group was guilty of spreading “disinformation” and “paranoia” among the public.

Biden said the public wants stricter gun control measures despite the reluctance of lawmakers to pass them.

“This is one of the cases where the public is so far ahead of the elected officials, I mean so far ahead,” Biden said in pushing the Obama administration’s ongoing quest for stricter gun control legislation.

“You saw it in immigration. You saw it in marriage issues. You are seeing it now. The public has moved to a different place,” he added.

Biden slammed the argument that none of the gun control measures being pushed on Capitol Hill could have prevented the Newtown, Conn., school massacre last December — insisting the size of ammunition magazines is important.

"Well, No. 1, the police got there in two and a half minutes. If there'd only been 10 bullets in each clip, [the shooter] would've had to change the clip an additional three to five times.

"One of those kids would be alive. Somebody would be alive. Statistically, the probability is that he wouldn't have been able to get off 150 shots.”

Sen. Tom Coburn says the bipartisan gun control measure proposed by Democratic Sen. Joe Manchin of West Virginia and Republican Sen. Pat Toomey of Pennsylvania is the “wrong approach.”

In a statement released Wednesday, the Oklahoma Republican said the legislation expanding background checks to all commercial gun sales would put undue pressure on gun owners who follow the law, according to The Huffington Post.

“The Manchin-Toomey proposal is a good faith but unworkable plan,” said Coburn, who only weeks ago was reportedly working along with Manchin on a compromise bill. “The proposal will impose new taxes and unreasonable burdens on law-abiding citizens. The agreement also prioritizes collecting records over protecting citizens.”

Coburn also insisted that people will simply look elsewhere to purchase their firearms to avoid more extensive background checks that would include gun show sales under the Manchin-Toomey proposal. He said he doubts it will pass Congress in its current form.

“A government takeover of gun shows will open more loopholes than it closes,” Coburn said. “Instead of paying a gun show tax, gun owners will simply handle those transactions elsewhere. The Manchin-Toomey proposal, unfortunately, trades a workable way to improve access to the [FBI background check database known as NICS] for a system that is not workable and will be extremely difficult to pass Congress and become law.”

Coburn plans to offer his own amendment to the proposed legislation using bipartisan gun control proposals that he says were abandoned in the Manchin-Toomey bill.

“For instance, I’ll propose a consumer portal that would facilitate access to the NICS database at not just gun shows but for virtually all private sales,” Coburn said.

South Carolina Republican Sen. Lindsey Graham also told the Huffington Post that he doesn't support the Manchin-Toomey measure.

“Not a big fan of expanding background checks,” he said. “I appreciate the effort. I want to go a different way.”
